Insolvency Act Insurance

Insurance products can only be purchased by individuals who are FCA regulated. If you are a member of the public, we recommend speaking to your solicitor.

Insolvency Act Insurance protects property buyers and lenders from financial risk if a past transaction is challenged under the Insolvency Act 1986.

If a seller was insolvent when selling the property, creditors or a liquidator could claim the sale was undervalued or fraudulent, potentially reversing the transaction.

This insurance covers legal costs and financial losses if such a claim arises, ensuring security for your client.

Only FCA-regulated people can purchase this insurance, and we recommend doing so via a solicitor.

  • The amount by which the value of the property is reduced by the effect of a court order
  • Any other costs and expenses your client incurs with the insurer’s written consent because of an insured risk

The Insurer can refuse to pay a loss or reduce any payment for the loss because:

  • Your client disclosed that this policy exists for another person who is not a potential property purchaser, their mortgage lender, or their legal advisers
