From the 1st April 2005, all central heating boiler
installations fall under the control of building regulations, potentially
putting thousands of house sales at risk.
New legislation requires all gas boilers fitted into new and existing
homes to be high efficiency condensing boilers with either an ‘A’
or a ‘B’ efficiency rating.
When the Home Information Pack comes into force in 2007, all homeowners
will have to produce a certificate for any boiler installed after
1 st April 2005, proving the efficiency of the boiler, and that
it was installed by a qualified CORGI installer. And even before
the launch of the Pack, the purchaser’s solicitor’s
search could still identify the missing documentation, causing delays
and possible financial repercussions for all involved in the purchase.
We have prepared a quick check list to ensure that legal professionals
are in a position to brief their clients to avoid these problems:-
- All homeowners will now be responsible for ensuring central
heating work in their home complies with the relevant Building
Regulations.
- Any new boilers installed will need to be high efficiency/condensing,
energy efficient boilers at least SEDBUK band ‘A’
or ‘B’.
- There may be a few homes where it would be too difficult or
too expensive to fit one of these boilers. This would be classed
as an ‘exceptional circumstance’ and the installer
will be able to legally fit a non-condensing boiler instead. In
this instance, householders will have to produce an ‘exception
certificate’ provided by the competent installer.
- From 01 April local authorities must be told when you a new
or replacement boiler is fitted.
- The installer should inform the local authority, and arrange
a certificate to confirm that the new boilers conform to building
regulations. This should be confirmed by the homeowner.
- Certificate(s) will need to be produced the document when the
house is sold.
- The installer MUST be CORGI registered if they are fitting
a new gas boiler.
